This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which require publishing the rules and regulations, privacy policy, and terms of use for access or usage of the domain name https://bagsbushop.in/ (“Website”), including its related mobile site and mobile application (collectively referred to as the “Platform”).

By accessing, browsing, or using the Platform, you agree to comply with and be bound by these Terms & Conditions (“Terms of Use”), along with all other policies incorporated by reference, including our Privacy Policy, Return Policy, Shipping Policy, and Refund & Cancellation Policy.

If you transact on the Platform, you are subject to the policies applicable to such transactions. Your continued use of the Platform following updates to these Terms will constitute your acceptance of those changes.

For the purposes of these Terms, “you”, “your”, or “user” shall mean any natural or legal person who has agreed to become a buyer or user on the Platform.

You acknowledge that such information may contain inaccuracies, and we exclude liability for such inaccuracies to the fullest extent permitted by law.

5. Risk & Limitation of Liability

Your use of the Platform and services is entirely at your own risk. You are responsible for ensuring that any products, services, or information available through the Platform meet your requirements. We will not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform, except where required by law.

6. Prohibited Use

You agree not to use the Platform for any unlawful, illegal, or prohibited activities as per these Terms, Indian law, or local regulations. Unauthorized use of the Platform may result in legal action.

7. Third-Party Links

The Platform may contain links to third-party websites for your convenience. Accessing these links is at your own risk, and you agree to be bound by the terms of use and privacy policies of such third-party websites.

8. Payment & Pricing

You agree to pay all charges displayed at checkout for purchases made through the Platform. Prices and payment terms are subject to change without notice.

9. Return, Refund & Exchange Policy

  • Return Window: Returns are accepted within 10 days from the date of delivery.

  • Condition: Returned products must be unused, undamaged, and in their original packaging with proof of purchase.

  • Refund Processing: Approved refunds will be initiated within 5–7 business days and credited to your original mode of payment.

  • Exchanges: Replacement products will be shipped within 5–7 business days once the return is approved.

  • Defective or Damaged Items: Full refunds or replacements are provided if the product is reported as defective/damaged within 10 days of delivery.

Products that do not meet these requirements, or those specifically marked as non-returnable, will not be eligible for return or exchange.

10. Data Retention

We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected or as required by law. Once the purpose is fulfilled, we securely delete or anonymize your data for research, analytics, and fraud-prevention purposes.

You may request account deletion through your profile settings or by contacting us. Requests may be delayed if there are pending transactions, disputes, or legal obligations.

You agree to indemnify, defend, and hold harmless the Platform Owner, its affiliates, officers, directors, employees, and agents from any claims, damages, or expenses arising from your breach of these Terms, violation of law, or infringement of third-party rights.

12. Force Majeure

We will not be liable for any delay or failure in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, internet outages, or governmental actions.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts in Odisha.
